General Terms and Conditions (GTC) for Coaching Services and Facilitation

 

1. Purpose of the GTC
Unless otherwise agreed in writing between the Coach and the Client, these General Terms and Conditions (GTC) apply to all coaching and facilitation services offered by Ratha ROS (hereinafter "the Coach"). They define the conditions under which these services are provided to the Client, and any order implies full and complete acceptance of these GTC.

 

2. Description of Services
The Coach offers personal and professional coaching services designed to assist the Client in their personal or professional development and reflection. These services may include, but are not limited to individual sessions, group sessions, workshops, and follow-ups by phone or online.

 

3. Coaching Objectives
The specific objectives of the coaching will be defined jointly at the beginning of the collaboration and may be adjusted based on the Client’s needs and progress.

 

4. Duration and Organization of Sessions
Coaching sessions are generally organized according to the terms agreed between the Coach and the Client. Sessions may last from [45 minutes to 2 hours] and can span a period of several weeks to several months, depending on the initial agreement. The schedule and total duration of the program are set in advance and may be adjusted, if necessary, by mutual agreement.

 

5. Fees and Payment Terms
Service fees are stated in euros and may vary depending on the type of coaching offered (individual, group, etc.). The total cost of the services and the terms are specified in the quote or commercial proposal provided to the Client. Payment may be made by bank transfer, or any other means accepted by the Coach.

 

6. Session Rescheduling or Cancellation Policy
The Client may reschedule a session by informing the Coach at least [48 hours] in advance. Any session canceled or rescheduled less than [48 hours] before the scheduled appointment will be considered due and will not be refunded, except in cases of force majeure. The Coach also reserves the right to reschedule a session for reasons beyond their control and will inform the Client as soon as possible.

 

7. Termination and Renewal
Both parties are free to terminate this contract at any time with one week's notice. Cancellation of the contract by the Client before the end of the coaching program will not result in a refund. If the Coach terminates the contract, they agree to refund the amounts corresponding to the services not provided. The refund will be calculated on a pro-rata basis for the sessions already completed.
The contract may be renewed by amendment, in accordance with the terms and agreement between the signatories.

 

8. Liability
The Coach commits to using all available means to support the Client in achieving their goals, within the framework of a best-efforts obligation. The Coach cannot be held responsible for any decisions or non-decisions made by the Client, or for the consequences of any actions taken as a result of coaching.

 

9. Confidentiality
The Coach agrees to maintain the confidentiality of any information exchanged with the Client during coaching sessions, except where there is a legal obligation to disclose, or in the context of supervision, while ensuring anonymity.

 

10. Right of Withdrawal

The Client has the right to withdraw within 14 calendar days from the date of the agreement between the parties. To exercise this right, they must inform the Coach in writing before the expiration of this period. If the services have started before the end of the withdrawal period, the refund will be calculated on a pro-rata basis for the sessions already provided.

11. Personal Data Protection

Personal information collected as part of the coaching services is processed in accordance with current legal provisions regarding data protection. The Client has the right to access, rectify, and delete their personal data.

12. Governing Law and Jurisdiction

These GTC are governed by Luxembourg law. In the absence of an amicable resolution, in case of a dispute, the competent courts will be those in the jurisdiction of the Coach's registered office.
